Orlando Modification Lawyer

Modifications in the eyes of a court requires there to be a significant change of circumstances to prove that the original court judgement must be altered in some way.

Alcalde Legal helps with many types of modifications, including but not limited to the following:

  • Child Support Modification: This may be modified, usually pertaining to the amount of child support you pay or receive per month. One may seek a modification of child support if their income has decreased or the other persons income has increased.  Other modification cases may be because health insurance or day care costs have changed or a child has reached the age of majority.  If you are victorious, this change can go retroactive to the date you filed the modification petition.  It is important to file a modification petition soon after your change in circumstance as it will not go retroactive to that date.

  • Time Sharing Modification: Time sharing may be modified after a showing of a significant change in circumstances and that the modification would be in the best interest of the child.  A modification in time sharing is fact specific and can vary from case to case.

  • Alimony Modification: Alimony payment modifications can result in an increase or decrease in the monthly amount. If there has been a major change in your financial situation, we will help you through your alimony modification process. This modification depends on the original agreement, what alimony was awarded, the language of the final judgement and the current financial positions of the parties.

  • Equitable Distribution: This may NOT be modified; once the court rules on your assets and debts and where they go, it may not be altered .

Even slight modifications can have a large impact. Let us help walk you through the whole process. Having a lawyer familiar with the intricacies of these issues is imperative.
